STATESVILLE (AP) — An Iredell County prosecutor says a Davidson County sheriff’s deputy will not face criminal charges for fatally shooting a man last October along Interstate 40.

Sgt. Scott Culler was cleared of wrongdoing Thursday in the death of 41-year-old Adam Daniel Lopp along I-40 in Iredell County, The Winston-Salem Journal reports. Authorities said the shooting occurred after Lopp assaulted Culler while in handcuffs. An autopsy released Wednesday shows Lopp died from two gunshot wounds to the upper chest and abdomen. Another bullet grazed his right arm.

Dr. Jerri McLemore of Wake Forest Baptist Medical Center wrote in the autopsy that Lopp was in the back seat of Culler’s car, which did not have a barrier between the front and back seats.

The autopsy said Lopp became agitated, and Culler pulled the car over on the median, after which Lopp escaped from the car and became violent.

An investigative report says Culler discharged pepper spray and an electrical controlled device, neither of which were successful in controlling Loop.

Mikko Red Arrow, an assistant district attorney, says there was insufficient evidence to warrant a criminal prosecution.

McLemore said that according to medical records, Lopp suffered from manic depression with homicidal and suicidal tendencies.

Davidson County Sheriff David Grice said an internal investigation determined that Culler followed proper procedure and acted appropriately.
