MAXTON — A Charlotte man and a Lancaster County, S.C., rehabilitation center have been found negligent in an accident that killed a 1-year-old Maxton child and two North Carolina teenagers in 2007, according to the Laurinburg Exchange.
Frank Davidson, 43, and the Lancaster Recovery Center were each found civilly liable by a Marlboro County jury for the deaths of 1-year old Dale Oxendine of Midway Road, Maxton, and Abigail McBryde, 17, and Hannah McBryde, 18, both of Wagram. Abigail and Hannah’s brother, Nathan, who was 13 at the time, also was injured but recovered.
Authorities said that Davidson had cocaine in his system when the accident happened on U.S. 15-401 near McColl, S.C.
Davidson pled guilty in criminal court and he could receive up to 90 years in prison.
On Jan. 25, 2007, Abigail McBryde’s 2004 Dodge Neon was struck by Davidson’s 2003 Mercedes Benz at 9:20 p.m. The three teenagers and Oxendine were just leaving church. According to an article from The Robesonian in 2007, Hannah was Oxendine’s nursery school teacher at Terrific Kids Daycare in Wagram.
According to the N.C. Department of Correction, Davidson had previous DWI convictions in 1996 and 1997.
