Panel upholds Sealey’s firing

RALEIGH — The State Personnel Commission has upheld an administrative law judge’s decision that the N.C. Highway Patrol fired Robeson County Commissioner Hubert Sealey for good cause in May 2011.

In its ruling issued Friday, the commission said that the Highway Patrol had proved it had just cause to dismiss Sealey for personal misconduct. It also said that Sealey had not proven his case that he had been dismissed because of his race, which is black.

Sealey had been employed by the patrol since January 2003, and was assigned to the Motor Carrier Enforcement Division based in Fayetteville.

Senior Administrative Law Judge Fred G. Morris in December heard Sealey’s charges that the Highway Patrol discriminated against him because of his race when he was disciplined and subsequently fired. The judge also considered whether the Highway Patrol had just cause in terminating Sealey’s employment.

Sealey was accused of disobeying a direct order; neglecting his duties; violating explicit patrol policies dealing with outside employment; and lying during a patrol Internal Affairs investigation. He was fired from his position for conducting both private and county government business while on duty with the Highway Patrol, according to documents released by the patrol in June 2011.

According to documents released by the Highway Patrol, an investigation of Sealey’s activities while on the job showed that he violated at least four Highway Patrol directives and was guilty of lying; insubordination and neglect of duty, and violated rules about secondary employment and the limitation of that employment.

It was determined during the investigation that Sealey conducted county business over his county and personal cell phone while on duty, and conducted work while on duty for the private mental health company, Independent Community Based Services, which is owned by his wife.

According to the commission’s ruling, Sealey has 30 days to appeal to Robeson County Superior Court.

Shortly after Sealey’s dismissal from the patrol, the Robeson County branch of the NAACP complained that his firing was race related. The NAACP charged that several years ago another trooper, who was white, was found guilty of the same charges but was given a lesser penalty and kept his job.

A resident of Fairmont, Sealey is currently serving his third four-year term on the county Board of Commissioners as the District 2 representative. He did not return a reporter’s phone calls on Tuesday.

I can see why poor 'Ol Hubert THINKS he was fired for being black. See, he KNOWS he was HIRED for being black, now he thinks he got fired for the same thing. Pitiful.

This case should have minorities, especially Blacks, mad as hell, not because one of their own was mistreated, but rather because one of their own was caught red handed misusing the public trust and taking taxpayer money for a NCSHP job that wasn't getting done because he was too busy doing a private sector job. This is the worst kind of injustice to other minorities because it serves to cause other, possibly more legitimate instances or racism, to be completely ignored. As a Lumbee, I believe minorities should be willing to look in the mirror and be 100% honest about whether a perceived slight is truly race related or because we have just been found out to be in the wrong. If the race card starts being reserved for instances of legitimate racism, its effectiveness will skyrocket. As a final thought, I'm saddened that this sorry self serving excuse for a citizen still sits on our most important local governing body and I pray that some honest man in his district will unseat him at the next opportunity. Just a thought.

RACE... This is so PATHETIC. Well again the NAACP is proving what a racist, illigitament hate group they are. Why haven't they spoken out lately about black on black crime and the crime spree going on in east Lumberton by their race? What a joke you guys are. Noone respects the naacp anymore. You are just a hate group fanning your hate amoung yourselves and holding yourselves back. You beleive Sealey did no wrong because he's black?

How 'bout going to the "south-side" and addressing the crime, poverty, drugs and gang-warfare going on in that area?...

Oh, i get it.. it's not their fault, it's the white mans fault, and THEY ARE VICTIMS BECAUSE THEY ARE BLACK.

Well, let's see who will replace him! I hope this is a warning for the rest. We need all of the Commissioners put on review from an outside organization. We need new leadership.Ask them to cut their salaries, receive NO healthcare and retirement. Work for the people instead of living off of our backs. Hold them accountable for how our County is in poverty and they are keeping it that way. sign the online petition commissioners need to be held accountable WE CAN MAKE A DIFFERENCE!

Guess what, do what you are supposed to do and you want have to worry about getting fired. You didn't do what you were suppose to do so quit crying and take responsibility for it. Quit trying to say its a race issue when you didn't do the job. It wasn't because you were black it was because you were accused of disobeying a direct order; neglecting his duties; violating explicit patrol policies dealing with outside employment; and lying during a patrol Internal Affairs investigation. You know you were in the wrong and what consequences could be so take responsibility for it and quit throwing race card in it.
