PEMBROKE — A former Pembroke officer has been cleared on any criminal wrongdoing after he shot a man during an altercation in August, but he has not returned to his former job.
According to Town Manager McDuffie Cummings, the District Attorney’s Office found that Dustin Revels did not use excessive force in shooting 27-year-old Andrew Lowery of Deep Branch Road in the leg during an altercation at McDonald’s on West Third Street. According to Cummings, a video of the incident showed that Lowery was armed with a knife.
He said the video, which was a surveillance video provided by the restaurant, was viewed by District Attorney Johnson Britt.
“After watching the surveillance video, it was found that he was justified in his actions,” Britt said.
According to a Pembroke police report, Revels responded to a call at 4:20 a.m. on Aug. 8 that there was a fight in the parking lot of the McDonald’s. The report also stated that drugs and/or alcohol were involved.
Lowery did require surgery, but there were no signs of any permanent damage to his leg, according to Britt.
At the time, there were two pending warrants charging Lowery with possession of marijuana and making threats, according to the Robeson County Sheriff’s Office.
According to Assistant Chief Dwayne Hunt, Revels was terminated in September. Hunt said the termination was not related to the shooting, but he could not provide additional information because it is a personnel matter.
Lowery is currently in prison after he was convicted on charges of assault with a deadly weapon with the intent to cause serious injury and discharging a firearm on property, according to the North Carolina Department of Corrections. The charges are not related to the incident in August.
