Tribal lawyer: No $18M windfall

PEMBROKE — The Lumbee Tribal Council has it all wrong when it says the tribe has accumulated $18 million in unspent housing money since 2007, according to the tribe’s attorney.

Ed Brooks told The Robesonian that the council members don’t understand how money received from the U.S. Department of Housing and Urban Development is now recorded. The $18 million that council thinks has been sitting somewhere unaccounted for is actually the remaining balance of this year’s funding — totaling $4,120,241 — and the tribe’s 2012-13 HUD allotment of $13,048,620 that has already been deposited by the federal agency into the tribe’s 55 Account, Brooks said.

“Council members are looking at that $18 million and thinking it was from previous years,” Brooks said. “They also think that there will be an additional $13 million deposit in the 2012-13 fiscal year.”

Tammy Maynor, the tribe’s director of Governmental Affairs, said that the tribe definitely does not have $31 million available for providing housing services as council members would like to believe.

“It is confusion about when HUD allotments are received,” she said. “It’s a timing issue. We are actually operating on money a year behind.”

Alex Baker, the tribe’s Public Relations manager, said that the $4.1 million now available will be used for housing projects by Sept. 30, the end of the current fiscal year. There will then be just the 2012-13 fiscal year’s allotment remaining in the tribe’s 55 Account, with another deposit of several million dollars in housing money not coming from HUD until maybe August of next year.

At their regular monthly meeting Thursday, Pearlean Revels, the council’s speaker, and Councilman McDuffie Cummings announced that the $18 million had been growing yearly since 2007. They said that no one in the tribal administration or the council was aware of this money that could have been used to provide housing services to tribal members.

Cummings said that the $18 million will be added to the tribe’s fiscal 2013 HUD allocation of almost $13 million to bring the total amount of money available to build and repair homes to more than $31 million.

Council members said that they have been told by tribal administrators, including Chairman Paul Brooks, that there has been no money available to handle all of the housing needs being requested by tribal members. Currently there are more than 1,000 members of the tribe waiting to receive a new home or have their present dwelling rehabilitated. Some have been on a waiting list for several years.

Revels, the council’s speaker, told The Robesonian on Friday that she stands by the council’s analysis and interpretation of tribal financial records.

“That we are wrong is the administration’s opinion,” she said.

Brooks and other tribal administrators did not attend the Thursday meeting during which the council made the claim that $18 million had been lingering and unspent.

Maybe it's only 18 million left.There should be a deeper investigation into this. To see how much was really there from the start and who has the missing dollars. The Lumbee council has made their tribe look like a bunch of idiots for a long time now. Noone misplaces 18 million.

@RossIsRight: Ross, you said this bunch is "full time baptist church members". I have no doubt you're right. But.....I bet they're ALSO democrats. And you know the democrats put their belief in same-sex marriage on paper in black and white!!!! It dosen't make real good COMMON SENSE does it? Look for another gut-wrenching laugh from this bunch at any time.

ps: I think it should be "baptist cult" instead of "baptist church" but that's just my opinion.

Listen, this is not about the church. This is about individuals. We need to leave the church out of this. Gods word says this, " those among us without sin let him cast the first stone". This applies to none of us because we have all sinned and come short of the glory of God. Leave the church alone. The church is a sacred institution that we should abstain from bringing into this discussion.

UMMMM does the treasure go these meetings and do he/she ever read the financials... such as maybe..whats in the bank and what has been spent or is this for certain eyes only. I thought meetings included a secretary, treasurer, and board members. I would be looking into this a little deeper myself. Things like this could hurt the tribe in many ways if this is not being handled in a proper manner. Trust is a hard thing to get back when you loose it.

I hope everyone can see that this is purely political. Some on the council may not be the sharpest tools in the shed, but they know exactly what they are doing, which is trying to make the current administration look incompetent right before the election. Sounds familiar doesn't it. There is no way that HUD, the Inspector General, the Tribes independent auditors or government auditors, or the administration could miss this kind of money over 5 yrs. Not with the reporting guidelines that HUD has in place using generally accepted accounting principles. I can't believe how naive our people have been to believe this. This would not have been a story if the tribal members reviewed and understood the budget.

It is embarrassing to have representation that results from popularity versus qualification!

Unfortunately, the individuals who could best represent the Lumbee people will probably never run for the council because they do not want to be part of a dysfunctional governing body.

Percy, Percy, Percy give this bunch a break. I agree they are funny as all get out. Ignorance is bliss. Unfortunately some people just don't know when they are in over their heads. No way can a group of this calibre understand everything associated with HUD funding. I have said all along that tribal council members need to be an educated group with a background in business. Also administration needs to be educated and business oriented as well. When you allow just any Joe Blow off the street to be able to run for a position like this you are asking for trouble and LAUGHS as well. We have got this all wrong. Knowing our people it will continue to be a joke to the end.

This is just absurd. The entire tribal government is a huge train wreck. The Federal Government and HUD needs to step in and protect the taxpayers and stop this nonsense. There should be no "confusion" about how HUD payments work and how they are to be used.

Where they belong. As long as ABSOLUTELY NOTHING is done about these shenanigans, like with the 3 I mentioned, there is NO incentive for them or others just like them not to do the same thing over and over.

Yes, you're confused. The fiscal year runs from October to July. HUD deposited $13 millionish for the new fiscal year, and there are still funds left from the previous fiscal year. Apparently someone saw the account statement and assumed $18,000,000 fell from the sky.

I have seen the crime pays SUV. What a fool.
