BOLIVIA (AP) — A former district attorney for Bladen, Columbus and Brunswick counties and his assistant have been indicted by a grand jury for filing false expense reports.

The N.C. Department of Justice said Monday that Rex Gore, the former district attorney, was indicted on a charge of felonious conspiracy to obtain property by false pretenses. Elaine Kelley, the assistant district attorney, was indicted on charges of obtaining property by false pretense and felonious conspiracy to obtain property by false pretenses.

The indictment says that between 2005 and 2010, Kelley falsely claimed travel from Elizabethtown to Bolivia totaling more than $14,000 and that Gore knowingly signed off on the reports.

Gore said in a statement that he had no reason to doubt Kelley’s travel, nor any intent to overstep his authority. According to The Fayetteville Observer, Kelley resigned in early 2011. She previously was a prosecutor in Cumberland County.

Gore served as a district attorney for 20 years before losing a re-election bid in 2010. He reportedly said he was “disappointed” with the decision to prosecute him and that he does not believe the arrangements for Kelly’s travel were wrong.

According to the Fayetteville newspaper, the indictment says that both Gore and Kelley knew “the alleged travel in question was in fact false and was calculated and intended to deceive the Administrative Office of the Courts.”

Gore reportedly said in a statement that the charge is the result of a decision he made upon hiring Kelley to include a “travel component in her compensation package” because she would be commuting more than 500 miles a week to her job in Elizabethtown.
