PEMBROKE — A former Miss Lumbee is suing the Lumbee Tribe of North Carolina, claiming that the tribe covered up incidents of sexual harassment and battery that occurred while she worked in the tribe’s Housing Department.

Charlotte attorney Josh Van Kampen filed the lawsuit Tuesday in Mecklenburg County Superior Court on behalf of Ashley Haywood, a Lumberton resident and Miss Lumbee 2008. Among other things, the lawsuit says that an employee of the tribe groped and forcibly kissed Haywood.

The lawsuit says the incidents date back to late 2009 and claims infliction of emotional distress and false imprisonment, battery and wrongful termination. Those listed as defendants in the lawsuit include Lumbee Tribe Enterprises, Jimmy Hunt, and current tribal Chairman Paul Brooks. Hunt is a candidate for Tribal Council in next month’s election.

A spokesman for the tribe on Wednesday would not comment, saying that the tribe has not yet been served with the lawsuit.

Hunt, who is a reverend, told The Robesonian on Wednesday that all of the charges are “bogus” and “lies.”

Hunt, who was Haywood’s supervisor in the tribe’s Housing Department, said that Haywood began making allegations against him after he told her that if her work didn’t improve, he would “have to let her go.”

“It’s all about finances,” Hunt said. “Her work was so substandard I tried to help her and I had others work with her to try to improve her work.

“I welcome my day in court. I want to clear my name.”

In her lawsuit, Haywood alleges she was verbally and physically harassed by Hunt between October 2009 — shortly after she was hired by the tribe as a housing specialist — and January 2010. She continued to work for the tribe until she was fired June 19 of this year.

The lawsuit contends that Hunt made statements to Haywood such as, “My wife doesn’t fulfill my needs so I need a young woman like you to do that,” and downloaded a pornographic video on her computer, asking, “Can you do that?”

The lawsuit says that Hunt on Nov. 3, 2009, shoved Haywood into a corner of her office, grabbed her waist, pressed himself against her, groped her and forcibly kissed her.

According to the lawsuit, when Haywood reported Hunt’s actions, she was told by tribal officials she would be fired if she should pursue the complaint.

Hunt allegedly continued to abuse Haywood until January 2010, when she was told by tribal officials that Hunt was gone and would “never be hired back.”

In May of this year, Brooks hired Hunt back for three weeks before firing him. Hunt said Wednesday that Brooks gave him no reason for why he was fired.

The lawsuit contends that when Brooks re-hired Hunt, Haywood had to be hospitalized as a result of a panic attack. She missed three days of work, the lawsuit says.

Haywood filed a grievance June 8 with Brooks and the tribe’s Human Resources Department concerning Hunt’s rehiring, according to the lawsuit. On June 15, she was suspended. She was fired four days later for insubordination, the lawsuit contends.

Van Kampen told The Robesonian on Wednesday that the lawsuit was filed in Mecklenburg County so that Haywood could get a fair trial. He said he did not believe that was possible in Robeson County.

Van Kampen said the case is “unique” in regards to the degree of the sexual abuse and the fact that the “tribal entity turned blind eyes” to Haywood’s allegations of abuse when she reported the incidents.

According to the lawsuit, Haywood is seeking damages as well as lost back and future wages and benefits.

I don't think that Ms. Haywood is the first person with the tribe to misuse funds...whatever happened to Mr. Purnell and his Advocate Townsend...was it swept under the rug did they ever reimburse the money that they misused or were there any charges against them? How about the enormous amounts of money that is misuused by the tribe for housing....helping people that don't need the the help but turning people away that really need the assistance! Personally, I don't think any Indian should handle this money, most of them suffer from CRICKET SYNDROME anyway! As for the Rev. Jimmy Hunt,GOD has your number! You can hide from man but not from GOD! What you do in the dark WILL be brought to the light. You will suffer from doing your dirt to people and hiding behing the BIBLE and GOD! I pray that everytime you stand behind the pullpit to preach GODS word all that GOD allows to come out OF YOUR MOUTH is the confessions of your wrongdoings to these women. Because you have no more business preaching to a congregation than a child molester has in a daycare center! REV, you better seek repentance cause your day of judgement may be closer than you think....WELCOMED OR NOT!!

WOW....that sounded like a threat to me....ummm makes you wonder uh? So let me see what accusations I can throw out there at you just because I didn't agree with what you just said. I guess since you obviously just threatened this mans life ( welcomed or not) you must be a psychotic murderer who has no concern with human life! Now do you agree or is it possible that people can make accusations against anyone even if they are ABSURD! well I guess we'll never know! And one more thing...since you are the only one that has just put a murder threat in print it sounds

I agree with you lumlady33, Ms. Haywood should have never received the crown for Miss Lumbee with her past, should have never been given the opportunity to run in the pagent. Who wants someone with a past as this representing the Lumbees? This is what the fools get for crowning her.

Boy people are so funny! You all see a chance to get back at an organization for whatever reason and you will jump on any bandwagon without knowing all the parts of a story! You are real quick to bring up Mr hunts past but I haven't heard anyone mention ms haywoods spotted history..I mean come on guys call it both ways. Be careful how you judge someone esp.when you involve Gods name.

hmmm... I think I agree. after reading the complaint filed, some of it seems stretched, and trying to drag the lumbee tribe down with it all..kinda funny how it happens round election time. and not lets forget that she isnt all inncocent too..drive by shooting 5 years ago...

I hope that all involved get what they deserve and I hope that she burns the Lumbee Tribe a new you know what. Those people in that office help who they want to help and step on the rest of us. But I hope that she seeks damages in excess of a few million dollars. It serves Jimmy Hunt right, but we are quick to say he is a reverend. Dont don matter if he is the pope. And as far as Mr. Brooks is concerned I hope he goes down as well. As far as I am concerned I sure hope that the Lumbee people don't get recongized and that money they have been receiving from the federal government, I hope they get burned for misallocating those funds as well. I am ashamed to even be associated with these bunch of greedy, perverted people who uses the Lord's name to cover up and their dirty deeds and get money to line their pockets. Lets face it, since the death of Juilan Pierce, Operation Tarnished Badge, and now the Lumbee Tribe's corruption, I am not surprised at this one bit.

I would assume the tribe like many organizations have some type of insurance to protect the administration against such claims. Knowing quite a bit about Human Resource procedure, I am sure there are three documents on hand within the tribal HR's office. First there is an incident report of the first contact which should have been handled by the Director of Housing since the issue took place in his department. Next, a report deatiling the meeting between the Director of Housing, Human Resource Manager and Mr. Hunt. Finally, a resolution letter placed in both employees files notifying them of any actions taken.

I do not believe any of these reports exist, I believe the Director of Housing, Human Resource Manager and many of the department heads are not even aware of how to handle a Sexual Harassment complaint.

This is just another example of the lack of leadership in the administration. The question aways seems to return to "how qualified are the administrators within each department"?

Well hopefullly our administrators were smart enough to have the appropriate insurance to protect the Tribe financially against this type of lawsuit. If not, where are the funds going to come from to pay for legal services and the settlement that this and other employees are going to get.

Let's not lie to ourselves, there will be monies paid!

We must remember that “sexual harassment” is illegal when it is so frequent or severe that it creates a hostile work environment or when it results in an adverse employment decision (such as the victim being fired or demoted). Employees are PROTECTED under both state and federal laws against workplace sexual harassment!! This investigation will play out in favor of Ms. Haywood because those that know Mr. Hunt know his past & what he is capable of. This time Mr. Hunt will face what he has done to not only Ms. Haywood but many more. If I remember correctly, the same inappropriate actions took place in Baltimore, Maryland years ago & finally Mr. Hunt’s past is catching up with him. GOD see’s all things & what’s done in the dark ALWAYS comes to light. For all other victims… your voice is important!! Many employees at the “tribe” have seen, heard things they probably wish they hadn’t but they are afraid because they too know their jobs would be at risk. This investigation will reveal more than we expect it to. If you are employed with the Tribe… prepare yourself for a rude awakening because this investigation will not be swept under the rug since Mecklenburg County Superior Court is now involved. I commend Ms. Haywood for stepping out & taking action!!

Remember what I said before, these people are all church members... They can hide from man, but they can't hide from God! Boy, talk about dirty old men.....

These guys are also married. How do their wives feel walking around in public? Ladies, people may not say anything to your face, but look behind quickly when walking away and you'll catch em laughing at you. This is a small community, and we don't like dirty old men having their way with little young girls.

It seems a lot of people are jumping to conclusions with this story and sadly judging the "victim." Charlotte news station wsoctv released the actual legal documents related to this case and it appears as though she did exactly what she should've done. It was reported and like many things dealing with "the tribe," it was swept under the rug. It's not that she's just now coming forward, she's just decided to proceed with a case. She reported the harassment when it first began. It's hard not to believe her, after reading the VERY detailed documents. We're all innocent until proven guilty, but read the legal documents, they give a whole lot more info than is being published on the robesonian...

Ashley certainly was not the first victim and probably not the last. Others reported, some didn't, some submitted, mostly with strikingly similar descriptions of Hunt's sexual conduct. Prior to the Lumbee Tribe, there was Baltimore.

According to the lawsuit she reported it to her superiors right away and they threatened to fire her...theres not exactly a surplus of jobs...if she was using rental properties to take pictures for profit and this was common knowledge and she wasnt fired then her superiors were in essence condoning her actions and the only time it has been mentioned was after she filed suit and only by username bloggers...

I wonder if her attorney knew of the actual reason she was terminated? Yeah it's known truth that she used her place of employment with the tribe for her photo studio and had been doing so for a while. All you have to do is ask the many people who she took pictures of before opening her studio. As I recall, during Tarnish Badge, there were several detectives who spent time in federal prison who was charged with using federal funds fraduelantly. Isn't this the same thing as HUD funding is federal money? Not saying that Ms. Haywood is a bad person but what about the other person's family? Those are good people as well. You would think that this attorney, Van Kampen, would have more tact about him than to make certain things so public. Guess all he sees is dollar signs. I hope she knows what she is doing here.

You're right again, Ross. If this bunch didn't get "recognition" the first 2 years of Sammy Obammy's reign, they'll NEVER get. You had a democrat (acting) president, and the Senate and House were overwhelming democrat majorities. The could have passed ANY bill they wanted to. And they didn't.

I'm not saying there was or wasn't sexual harrasement. But she was fired because she was using vacant housing that belonged to the tribe that she was suppose to be taking pictures of for sale/rent as her own personal studio and making money off those pictures. Her firing had nothing to do with any harrasement claim and she should not be able to get lost back and future wages or benefits.

Wouldnt that qualify as misuse of tribal property? Seems a stretch to call it insubordination...one week after filing a grievance shes suspended? Even with cause that is a horrible move on their part...we'll see how this all comes down...being election time sticks in the back of my mind...

Dawholetruth, you claim that her firing had nothing to do with harassment. In your first sentence, you said that you didn't know if there even WAS harassment. How do you know if she was fired as retaliation for her claim of harassment when you yourself profess no knowledge of said event? Even if you have evidence of your claim of misuse of tribe property/equipment(which I doubt that you do), it is irrelevant to her claim of harassment. Let me boil it down for you: If she were your daughter, would you still feel the same?

Love how the story slid in that mr hunt is a reverend...in this day and age that has zero bearing in a case like this other than character reference in which case is not the robesonians job to present... i question the timeline...file greivance, week later suspended and then she was fired 4 days later for insubordination (thats a broad paintbrush when you claim insubordination)...was she fired while suspended? Or the day she came back?....my prediction-settlement, which if the allegations are true i hope she doesnt do...
